CALIFORNIA PRIVACY RIGHTS

If you are a California resident (“consumer”), the California Consumer Privacy Act of 2018 (“CCPA”) grants you the right to request that we disclose to you, upon our receipt from you of a verifiable request, the following:

  1. The categories of personal information we have collected about you.
  2. The categories of sources from which the personal information is collected.
  3. The business or commercial purpose for collecting or selling personal information.
  4. The categories of third parties with whom we share personal information.
  5. The specific pieces of personal information we have collected about you.

While California residents have the right to opt-out of the sale of their personal information, Stronger U does not sell its members’ personal information, meaning that Stronger U does not share your personal information with third parties in exchange for money. California law defines “sale” very broadly, and so the sharing of information for advertising purposes may fall within its scope. While we do not share your personal information with third parties in exchange for money, we communicate certain information for business purposes with selected trusted service providers, acting under our instructions, in exchange for insights and other valuable services, to enhance your experiences with us, to improve our ability to serve you, and to keep you aware of our products, services, and offers. Under California law this could be considered a “sale,” and since our priority is to be transparent with you, we want to provide you with this explanation.

If you are a California resident, you have the right to request that we disclose to you, upon our receipt from you of a verifiable request, the categories of personal information that we have disclosed about you for a business purpose.

If you are a California resident, you also have the right under the CCPA to request the deletion of your Personal Information that we collect. All such requests are subject to verification according to methods determined by us. You may submit a request for the deletion of your Personal Information by sending an email to us at info@strongeru.com or by submitting a “CCPA Request” through the Customer Support portion of the Stronger U app.

Even though we do not sell consumer Personal Information, if you are a California resident, you also have the right under the CCPA to opt-out of the sale of your Personal Information. All such requests are subject to verification according to methods determined by us. You may submit an opt-out request by sending an email to us at info@strongeru.com with the subject “CCPA Opt Out Request, ” by submitting a “CCPA Request” through the Customer Support portion of the Stronger U app or by clicking the “Do Not Sell My Personal Information” link on the Website.

Upon our receipt of a request by a California resident to exercise rights under the CCPA, we first must verify that the person making a request is the consumer about whom we have collected information. Accordingly, we will ask you to confirm your postal address and the name of the coach on your account and we may ask for additional information you previously provided to us that may be in our records, and we also may request a copy of your valid government-issued identification. If the request to exercise rights under the CCPA is initiated by a coach, we will ask you to confirm the last four digits of your Social Security Number and date of birth.

You have the right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA. However, nothing prohibits us from charging a consumer a different price or rate, or from providing a different level or quality of goods or services to the consumer, if that difference is reasonably related to the value provided to the consumer by the consumer’s data.

You may exercise any of the California Privacy Rights described in this section by sending such a request to us by email. We may ask you to verify your identity before taking further action on your request. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, a copy of your valid government-issued identification and your authorized agent’s valid government-issued identification.

Please note that we are not required to comply with a California resident’s request to delete personal information if it is necessary for us to maintain the Personal Information in order to:

  1. Complete the transaction for which the personal information was collected, provide a good or service requested by the consumer, or reasonably anticipated within the context of our ongoing business relationship with the consumer, or otherwise perform a contract between us and the consumer.

  3. Debug to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, if the consumer has provided informed consent.
  7. To enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with us.
  8. Comply with a legal obligation.
  9. Otherwise use the consumer’s personal information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.

We will begin to process your request within 30 days of our receipt.
